TN Supreme Court Rule 38: How to Use It In Your Mediation Practice
Under this rule, the court may refer the parties in cases involving parenting arrangements in divorce, legal separation, annulment, or separate maintenance proceedings to take part in alternative dispute resolution processes, either upon motion by a party or upon its own motion. Neutrals may be selected either by the parties or by the court. The rule provides procedures for supplying reimbursement to neutrals and paying costs, with focus given to determinations of fee reductions and referrals to pro bono or reduced fee ADR processes.
